The "FSA", explained that it was extending the suspension of its normal rules, which require banks to deal with complaints promptly, because the 'High Court', has still not decided if "Bank / Building Societies", overdraft charges are unfair or not.
Bank / Building Societies - "Will not be required to handle complaints relating to unauthorised overdraft charges within the time limits set out in the dispute resolution manual," the FSA stated in an official statement to the press, and certain commissions.
The FSA continued to say "Defining hardship as an income "insufficient to cover reasonable living expenses and meet financial commitments as they become due," it said that "Bank / Building Societies", might deal with customers in this situation by waiving charges in the future, or not enforcing past ones if the debt itself consisted of previous overdraft fees.

You recently proposed the idea of a consumer advocate – someone who would fight over issues such as unfair bank charges.
We were delighted to see you take interest in this crucial issue, especially as the ‘Bank Charges Consumer Charter’ posted on the number 10 website in Summer 2007 held the undistinguished honour of being the largest ever petition you chose not to respond to.
Specifically I want to ask you to support an act of real political bravery, these unlawful bank charges were taken from peoples’ accounts without asking. No other companies have the power to take cash in this way, if an energy supplier has a dispute with you, it needs to go to court to get the money.
So surely once it’s finally legally decided that they’re unfair, the only right decision is for everyone who’s had bank charges to automatically be paid the money back without needing to ask for it !!!!
This is a crucial issue, from my website alone over six million free template letters have been downloaded, over a million people are currently on hold, and many millions more eligible. Yet the need to apply for a refund favours those with broadband access, and who are financially literate.
The worry is that many who are most in need – the enormous numbers with financial phobias, mental health issues, or literacy or numeracy problems – won’t be able to reclaim. The banks have been blind to their issues and charged them regardless and we must help people get their unlawfully taken money back.
We’ve already received and published replies from the Tories and Lib Dems on this. Nick Clegg has pledged support for automatic payback, David Cameron that payback must be swift and he will look at automatic payback.
With the test case coming to an end surely it’s time we knew your plans.

I certainly agree once the legal issues have been resolved, any compensation due should be paid as swiftly as possible. How compensation should be paid depends on how the case is resolved.
I know for consumers fighting for fair treatment the extremely lengthy legal processes can be unacceptable. As you know, people in financial difficulties can still have their complaints heard now, and your website gives helpful information on this. The Government is committed to doing all we can to agree better ways of resolving cases involving mass complaints in future.
As for the charges that are the subject of the test case, I believe that a negotiated solution could be in everyone's best interests, and so we have called on the banks and the regulators to explore a quicker way to resolve this without further delay.
People need confidence that when they open an account, they will be treated fairly, charges and fees will be transparent and reasonable, and their savings will be safe. I am pleased to see that RBS, Natwest, Halifax and Bank of Scotland have all announced substantial reductions to their charges in recent days, which will immediately help many thousands of consumers.
We are now taking extensive action to reform the banks culture, to stop irresponsible banking practises, and to support more effective consumer education and information so that people can get a better deal.
As your website and your campaigns have shown, our efforts to ensure that our banking system of the future is sustainable, responsible and transparent, must go hand in hand with efforts to put power back into the hands of consumers and ensure a fair deal for all.

APRIL 2009 - BANKS APPEAL TO THE HOUSE OF LORDS
The "Bank / Building Societies", have been granted permission by the "House of Lords", to appeal against the recent Bank charges "Appeal Court Judgement".
In March the "Appeal Court" upheld a "High Court", decision that the fairness of overdraft charges could be investigated by the "Office of Fair Trading", (OFT).
FEBRUARY 2009 - "BANKS APPEAL IS DISMISSED"
An appeal by eight "Bank / Building Societies", namely (Abbey, Barclay's, Clydesdale, HBOS, HSBC, Lloyd's TSB, Nationwide and RBS), against a "High Court", ruling that a regulator can investigate the fairness of overdraft charges, has been thrown out.
"The Appeal Court", ruled that the "Office of Fair Trading" (OFT), has the power to investigate the issue of "Bank / Building Societies", charges.
Tens of thousands of claims currently on hold in the English and Scottish legal systems will stay frozen.
The (OFT) welcomed the "Appeal Court", ruling.
"The court found that these terms are not part of the core or essential bargain between a consumer and their "Bank / Building Societies", and therefore consumers do have protection under the "Unfair Terms in Consumer Contract Regulations" (UTCCR's), for these terms," the OFT said.
"The "Bank / Building Societies", continue to believe that the "Regulations", do not apply to these type of charges," a spokesman said.
The "Bank / Building Societies", had argued last year, in both the "High Court" and the "Appeal Court", that their overdraft charges fell outside the scope of the "1999 Unfair Terms in Consumer Contracts", regulations.
"The issues should now be resolved by an "OFT", assessment of fairness," he added.
He refused the "Bank / Building Societies", leave to appeal further, but they have decided to apply anyway directly to the "House of Lords", for permission to appeal.
"It is great to see the "Court of Appeal", being so unequivocal in their guidance to the banks that this is the end of the road."
"They should now let the "OFT" do its job. The "Bank / Building Societies", have the right to appeal to the "House of Lords" but the "Court of Appeal" could not have been clearer that that is not the appropriate way to go forward," he added.
DECEMBER 2008 - BANKS PREPARE FOR OVERDRAFT REFUNDS !!!!
The "RBS, NatWest" Banks are planning to refund overdraft fees to customers "pro-actively", if it loses the continuing test case over "Bank / Building Societies", charges.
An internal Bank document reveals for the first time the preparations banks are making should they lose their case. The document acknowledges the group may have to refund past charges, which could run to many "Millions", of pounds.
